1. Acceptance of Terms

By accessing and using this Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated here in by reference.

2. Description of Service t

VVK OTT is an OTT platform that provides users with access to local content and talents, including videos, shows, and other media. The content available on the Platform may vary over time and by geographic region. We offer different subscription plans, some of which may be subject to fees.

3. User Accounts

Registration: To access certain features of the Platform, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

- Account Security:

You are responsible for maintaining the confidentiality of your account credentials, including your username and password. You agree to accept responsibility for all activities that occur under your account. You must notify us immediately of any unauthorized access to or use of your account.

- Eligibility:

You must be of legal age in your jurisdiction to create an account and use the Platform. By registering for an account, you represent and warrant that you meet this requirement.

4. Subscription and Payments (if applicable)

- Cancellation:

You can cancel your subscription at any time through your account settings. The cancellation will be effective at the end of your current billing period. We do not provide refunds or credits for any partial subscription periods, except as expressly stated in our Refund Policy.

5. Content and Intellectual Property

- Our Content:

All content available on the Platform, including videos, text, graphics, logos, images, and software, is owned by or licensed to VVK OTT and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, and revocable license to access and view the content for personal, non commercial purposes only

- User-Generated Content (if applicable):

if you contribute content to the Platform, you retain ownership of your intellectual property rights. However, you grant VVK OTT a non-exclusive, royalty-free, worldwide, perpetual, irrevocable, and sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such content in connection with the Platform and our services. You represent and warrant that you have all necessary rights to grant this license.

- Prohibited Use:

You may not download, copy, reproduce, distribute, modify, display, perform, publish, license, create derivative works from, offer for sale, or otherwise use the content on the Platform except as expressly permitted by these Terms. You may not circumvent, disable, or otherwise interfere with any security features or content protection mechanisms on the Platform.

6. User Conduct

You agree not to use the Platform in any way that:

* Violates these Terms or any applicable laws or regulations.

* Infringes upon the intellectual property rights of VVK OTT or any third party.

- Is harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another’s privacy, hateful, or racially, ethnically, or otherwise objectionable.

* Transmits any viruses, worms, malware, or other harmful code.

* Attempts to gain unauthorized access to the Platform, other accounts, computer systems, or networks connected to the Platform

- Interferes with or disrupts the operation of the Platform or the servers or networks used to make the Platform available.

- Collects or harvests any personally identifiable information from other users without their consent

- Impersonates any person or entity or falsely states or otherwise misrepresents your affiliation with a person or entity.

7. Disclaimer of Warranties

THE PLATFORM AND ALL CONTENT AND SOFTWARE ASSOCIATED THEREWITH ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.

VVK OTT DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR- FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY CONTENT ON THE PLATFORM. YOUR USE OF THE PLATFORM IS AT YOUR SOLE RISK

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL VVK OTT, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES) ARISING OUT OF OR RELATING TO YOUR USE OF THE PLATFORM OR THESE TERMS, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF VVK OTT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE PLATFORM OR THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO VVK OTT FOR THE USE OF THE PLATFORM IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY, OR IF NO SUCH PAYMENT WAS MADE, THE SUM OF [Specify a nominal amount, e.g., INR 500]

9. Indemnification

You agree to indemnify, defend, and hold harmless VVK OTT, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to: (a) your use of the Platform; (b) your breach of these Terms; (c) your violation of any third-party rights, including intellectual property rights or privacy rights; or (d) your user-generated content.

10. Termination

We may terminate or suspend your access to the Platform and/or your account at any time, with or without cause and without prior notice. Upon termination, your right to use the Platform will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive termination, including, without limitation, intellectual property provisions, disclaimers of warranties, limitations of liability, and indemnification.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the Platform shall be subject to the exclusive jurisdiction of the courts located in Hyderabad, Telangana, India.

13. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.

14. Waiver

No waiver of any provision of these Terms shall be effective unless expressly made in writing and signed by an authorized representative of VVK OTT. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision
